“Eskom is in the middle of a crisis in which a High Court judge gunning for a seat at the Constitutional Court is alleged to have made a ‘material error’ in his ruling to review and set aside a bitterly disputed R14bn fuel oil supply contract in favour of the power utility. At the centre of the predicament is Judge Bashier Vally’s reliance on a confirmatory affidavit, which he said was deposed by Eskom former group legal head, Bartlett Hewu. That the affidavit was never submitted because it allegedly never existed is confirmed in an admission by Eskom attorney, Aslam Moosajee, when confronted in a text message by Hewu regarding Vally’s alleged inclusion of evidence he did not submit. City Press notes Hewu, in his text message, pointed out the fact that Vally relied on non-existent evidence in the form of an affidavit, in Hewu’s name, to confirm an allegation against Econ Oil, which he eventually ruled against, thus giving Eskom permission to have the R14bn fuel oil supply contract reviewed and set aside. In his ruling, Vally wrote: ‘Mr (Solly) Tshitangano (former head of procurement) and Hewu have both provided sworn testimony – in the form of confirmatory affidavits – to this effect, which is not refuted but instead is only met with a bare denial by Econ …’ Econ Oil has since petitioned the SCA to have Vally’s ruling overturned on the basis that he had made factual errors of fact and law, including his acknowledgement of and reliance on a non-existent piece of evidence he inserted in his ruling. In March 2021 the German Federal Constitutional Court (Bundesverfassungsgericht) found the Federal Climate Change Act (Klimaschutzgesetz) to be partially unconstitutional to the extent that it failed to protect persons from future restrictions that may become necessary after 2030 as the danger of climate change evolves.

Walter Sisulu University: Postdoctoral Research Fellowships
The Directorate of Research & Innovation in the Division of Academic Affairs and Research has a limited number of Postdoctoral Research Fellowship opportunities for 2021 and hereby invites applications from eligible individuals who obtained a doctoral degree within the last five years. The overall goal of the fellowship is to enhance the research and innovation culture at the University by affording recent doctoral degree holders an opportunity to contribute to knowledge production in different fields of expertise. The fellowship will be awarded on a competitive basis, taking into account the applicant’s research potential. Postdoctoral Research Fellows are needed in the following areas:

  • Cardiometabolic research
  • Nanostructured Solar Cell Technologies
  • Financial Reporting and Sustainability or Accounting Education
  • Effects of heavy metals and emerging contaminants (e.g. microplastics and pharmaceuticals) on aquatic ecosystems
  • Human Rights and Development (Law) Duties and Responsibilities
  • Publishing quality articles that will result in at least two (2) research output units accruing to Walter Sisulu University.

Note that the two units must be the total credited to the Fellow’s name and not a shared total. Eligibility Applicants must meet the following eligibility criteria:

  • A doctoral degree obtained in 2015 or later
  • Excellent written and oral communication
  • High level computer skills
  • Evidence of published research output

Value of the fellowship:

  • The value of the fellowship is R350 000.00 per annum (tax-exempt), and is awarded for a period of one year.

The Fellowship may be renewed for a further two years, subject to satisfactory performance, as attested to the Fellow’s Host/Academic Mentor in the first year, and subject to availability of funding.

France – South Africa Scholarship Programme
Directed to South African students who intend to study in universities or higher education institutions in France for their Master’s degree or PhD.
The programme is also open to students from Lesotho.

The current call for applications is open for students who intend to start their studies in France in September 2022. Applicants will be contacted individually as needed. The list of the laureates and the waiting list will be announced according to the indicated timeline. Follow-up requests by applicants will not be answered.
Due to the differences between the Southern and Northern hemisphere calendars, laureates will follow a specific programme in South Africa from January to July 2022. This track will include online French courses organized by the network of the Alliances Françaises. The Constitutional Court Trust (CCT) is launching a fellowship programme to benefit young lawyers committed to forwarding constitutional and human rights law
“The fellowship opens to candidates from 2022 and will afford one early career lawyer per year the opportunity to study towards an LLM at University College London (UCL) , one of the top-ranked universities in the world.
The new fellowship is named in memory of the late chief justice Pius Langa. “Justice Langa was not only central to the establishment of the Constitutional Court Trust but, more importantly, his dedication, humility and commitment to the notion that service must be at the heart of leadership are rare qualities we believe young lawyers should be aspiring to emulate in contemporary SA,” said CCT chairperson Justice Sisi Khampepe.
Langa’s family welcomed the establishment of the fellowship, saying: “We look forward to seeing a new generation of lawyers committed to justice and transformation in Africa being developed through this fellowship programme.”
Other fellowships administered by the CCT have been limited to selected former clerks of the Constitutional Court and the Supreme Court. In the case of this new fellowship, however, the decision was taken to extend this opportunity to include exceptional young South African and African lawyers who have worked for an SA NGO in a legal programme focused on constitutional and human rights law.
Prof David Bilchitz, a trustee of the Constitutional Court Trust and professor at both the University of Johannesburg and the University of Reading, said: “We hope that the opportunity to study for an LLM degree will further contribute to strengthening civil society and its contribution to the advancement of constitutional democracy in our country.”
The fellowship award will be for £20,000 to cover travel and living expenses for the fellow, funded by the CCT’s kindred organisation the UK-based charity the South African Constitutional Court Trust — UK. UCL Faculty of Laws will be providing a full-tuition waiver (2021 value: £28,500) to the fellows selected by the CCT.
